Heard learned counsels for the petitioner and the State.

The petitioner is languishing in custody since 28.08.2012 in a case registered for the offences punishable under Sections 147, 148, 149, 121, 307, 353 of the Indian Penal Code, 25(1-b)a, 25-1A, 25-1AA, 26(II), 27, 35 of the Arms Act, ¾ of the Explosive Substances Act and 17 of the Criminal Law Amendment Act.

It is alleged that when the extremists were chased by the police then indiscriminate firing was made when the police also resorted to cross-firing. The petitioner's name sprang up during investigation when he was found roaming around the place of occurrence one day prior to occurrence and considering the same other accused person has been granted bail by this Court vide Cr. Misc. No. 42129 of 2012.

Considering the aforesaid facts, let the 2 Patna High Court Cr.Misc. No.8630 of 2013 (4) dt.08-08-2013 2/2 petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Sherghati, Gaya, in connection with Barachati P.S. Case No. 135 of 2006.

Since the petitioner is involved in two other cases, learned court below will be at liberty to cancel the bail bonds of the petitioner if the petitioner defaults for two consecutive occasions or gets substantially involved in some serious nature of offence.
