Heard Sri Anil Kumar Misra, the learned counsel for the applicant, the learned AGA for the State and perused the material on record.

By means of this application, the applicant who is involved in Case Crime No. 194 of 2017, under Sections 302, 364 IPC, Police Station Kumarganj, District Faizabad, is seeking enlargement on bail during the trial.

This is the second bail application on behalf of Munna. The first bail application was rejected by Hon. Anant Kumar, J on 01.08.2018.

The learned counsel for the applicant has submitted that in the trial the entire evidence has been led. The counsel submits that no one, including the complainant, has supported the prosecution case and the prosecution is lingering the case on one ground or the other while frivolous applications are being moved before the court below.

The case is of gruesome murder of a mother and her child. The allegation was that in order to force a compromise in a rape case this crime was committed. This Court, at this stage is not in a position to comment upon the complicity of the applicant. Witnesses have given their statement before the court and at this stage it would not be proper for this Court to comment upon the probative value of their testimony as that might affect the trial. Since no new ground has been taken, in the opinion of the Court, no case for bail is made out.

Since the applicant is in jail and the entire evidence has been led, the trial Court is directed to expedite the trial and, if possible, conclude the same within the next four months.
