Petitioner is an accused for allegedly committing the offence punishable under Sections 147, 148, 149, 323, 325, 307, 302, 333, 332, 124A, 120B of the Indian Penal Code, Section 27 of the Arms Act, Sections 3, 4, 5 of the Explosive Substance Act and Section 17(I)(ii) of the Criminal Law Amendment Act.
It is alleged that because of an explosion carried out by extremist group, one of the chowkidar died. Learned counsel for the petitioner submits that the petitioner is not named in the FIR and the other accused persons, who had been put on trial, have already been acquitted. He further submits that the chargesheet has already been submitted in this case.
This is a case of 2001 when the petitioner has surrendered only on 21.04.2017. Counsel for the petitioner, at this stage, submits that no sooner the petitioner had come to know about the pendency of this case, he surrendered.
Keeping in view the allegations leveled in this case and also taking into consideration that the petitioner has surrendered only on 21.04.2017, I am not inclined to enlarge the petitioner on bail at this stage. Accordingly, the prayer for bail of the petitioner, namely, Jitan Ganjhu @ Jogan Bhuiyan, in connection with Kunda Police Station Case No.06 of 2001, corresponding to G.R. No.379 of 2001, is hereby rejected.
The Trial Court is directed to take all steps so as to conclude the trial within 9 months from the date of receipt of a copy of this order. If the trial is not concluded within the said period, petitioner is at liberty to renew his prayer for bail.
This application stands dismissed.
