Section 40(7)(a) in Bank of Baroda (Employees') Pension Regulation, 1995

(a)where a female employee or male employee dies leaving behind a judicially separated husband or widow with a child or children, the family pension pay- able i respect of the deceased shall be payable to the surviving person provided he or she is the guardian of such child or children;
