ORDER
1. The appellant filed an application under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO), SBI Bikramganj Branch, Distt. Rohtas, seeking information on two points pertaining to his registered letter dated 26.12.2015 including, inter-alia, (i) present status of his letter, and (ii) action taken on the said letter.
Page 1 of 42. The appellant filed a second appeal before the Commission on the grounds that incomplete and incorrect information has been provided to him by the CPIO. The appellant requested the Commission to provide him complete and correct information.
Hearing:
3. The appellant, Shri Chandra Prakash Singh and the respondent, Shri Awadhesh Kumar, Chief Manager, SBI, RBO Sasaram, Bihar attended the hearing through video-conferencing.
4. The appellant submitted that he, along with S/Shri Lalan Singh, Anil Singh and Vinod Kumar Singh is a co-owner of a plot of land. However, the other three owners mortgaged the property, including his share to the bank for taking a loan, vide mortgaged deed number 8284 dated 14.11.2015. Hence, he had sought the action taken on his letter dated 26.12.2015 relating to rectification/removal of his share of land from the mortgage deed. However, the CPIO has not informed him about the action taken on the above said letter.

The respondent submitted that the CPIO vide reply dated 26.02.2016 has already informed the appellant that out of 9.55 acres of the land, 6.79 acres of the land was mortgaged with the Bank by S/Shri Lalan Singh, Anil Singh and Vinod Kumar as collateral security for the KCC loan sanctioned to them by Zonal Office Bikramganj in 2007. The appellant was advised that in case his land was erroneously mortgaged with the bank due steps for rectification/amendment in the records of the Bank in respect of his property shall be taken provided the appellant Page 2 of 4 filed an application along with the necessary documents before ZO Bikramganj. Hence, any further action regarding rectification shall be made after receipt of necessary documents from the appellant.
Decision:

The Commission, after hearing the submissions of both the parties and perusing the records, directs the respondent to provide the status report regarding the action taken on the appellant's letter dated 26.012.2015 relating to rectification in respect of his property wrongly mortgaged with the bank to him within a period of four weeks from the date of receipt of an application alongwith the requisite documents in this regard under intimation to the Commission.
7. With the above observations, the appeal is disposed of.
8. Copy of the decision be provided free of cost to the parties.
