Section 4 in Jaunsar-Bawar Zamindari Abolition and Land Reforms (Chapter III) Rules, 1961

4. Stay of certain suits and proceedings.

- All suits and proceedings whether of the first instance, appeal or revision of the nature as hereinbelow specified, in respect of the land for which a notification under Section 15 has been issued, pending in any court at the appointed date and all proceedings, except insofar as they relate to the realization, otherwise than by ejectment of the judgement-debtor, of cost or compensation awarded in any suit or proceedings in respect of any decree or order, unless it is a decree or order which became final before the appointed day, but is not a decree which may be executed by ejectment of the judgement-debtor, passed in any such suit or proceedings previous to the appointed date, shall be stayed :
(a)All suit, applications of proceedings including appeals, references and revisions relating to, or pending for, the ejectment of tenants from their land.
Explanation. - For the purposes of this clause, tenants include maurusi tenants or ghair-maurusi tenants, as recognized in the "Dastar-ul-amal of Jaunsar-Bawar" or tenants holding land in lieu of service.
(b)suit, applications and proceedings, including appeals, references and revisions, arising out of the above;
(c)all cases of execution of decree relating to debts which are wholly or partially charged upon, decreed against, any land, or any part thereof acquired under the Act.
Explanation. - For the purposes of this clause debt means an advance in cash or kind, and includes any transaction which is in substance a debt but does not include a debt due to:-
(i)the Central Government or Government of any State;
(ii)a local authority;
(iii)a scheduled bank; and
(iv)a co-operative society registered under the Co-operative Societies Act, 1912.
