04/03.02.2026 Heard learned counsel appearing for the petitioner as well as the learned counsel appearing for the State.
2. The petitioner is apprehending his arrest in connection with Ramgarh P.S. Case No.80 of 2025 for the alleged offences registered under Sections 303(2) and 317(5) of Bharatiya Nyaya Sanhita, Rule 4/54 of Jharkhand Minor Mineral Concession Rules, 2004, Section 21(1) and 4(1)(A) of Mines and Minerals (Development & Regulation) Act, 1957, and under Rule 7/13 of Jharkhand Minerals (Prevention of Illegal Mining Transportation and Storage) Rule, 2017, pending in the Court of learned Judicial Magistrate 1st Class, Dumka.
3. Learned counsel appearing for the petitioner submits that false allegation is made against the petitioner of storing 7500 cft. of sand on a particular land. He further submits that the land is not belonging to the petitioner and the person, who has taken the name --1-- A.B.A. No. 567 of 2026 2026:JHHC:2772 of the petitioner of the village, there is civil dispute between the petitioner and that person. He then submits that the petitioner has got no criminal antecedent as disclosed in paragraph No.07 of the petition.
4. Learned counsel appearing for the State opposes the prayer and submits that the name of the petitioner has been taken by Churka Marandi, who happened to be village Pradhan.
5. Considering that the name of the petitioner has been taken by the person who has amicable terms with the petitioner and the petitioner has got no criminal antecedent as disclosed in paragraph No.07 of the petition and in that view of the matter the petitioner is directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
