Date : 24-06-2020 (Ajai Lamba, C.J.) The Court proceedings have been conducted through Video-Conference.

2. We have heard Mr. K.N. Choudhury, learned senior counsel for the writ appellants/writ petitioners and Mr. D. Saikia, learned senior standing counsel, Government of Assam, appearing for the respondents.

This writ appeal/intra Court appeal has been filed by as many as 114 appellants/writ petitioners directed against order dated 22.01.2020 rendered by learned Single Judge in writ jurisdiction while dealing with WP(C) No.3807/2019 (Tarique Anwar Laskar & 142 Ors. -Vs- The State of Assam & 2 Ors.).

Short contention of learned counsel for the writ appellants is that specific issue was raised on behalf of the petitioners in Paragraphs 4 to 10 of the writ petition to the effect that 7042 posts of Lower Primary Level, Upper Primary Level, Social Science and Upper Primary Maths and Science Teachers had been advertised. However, beyond the number of posts advertised, 11319 candidates were appointed against the increased vacancies. It has been specifically pleaded in the writ petition that appointment of 11319 teachers has been without any advertisement, therefore, the writ appellants/writ petitioners had been denied the opportunity of competing for the posts in public service, which is against the constitutional scheme and particularly against service jurisprudence.

5. It has been argued by Mr. K.N. Choudhury, learned senior counsel for the writ appellants/writ petitioners that it was specifically made clear before the Writ Court that the writ appellants/writ petitioners are not challenging the recruitment of 7042 candidates appointed under the recruitment process initiated vide advertisement dated 30.06.2017. However, challenge is to the entry of 11319 candidates without advertisement by way of backdoor entry.

6. It has been pointed out that by virtue of the impugned order, the issue as raised has not been dealt with, rather the writ petition has been disposed of on the premise that 15000 more vacancies are being advertised and the petitioners would be at liberty to apply against those vacancies.

Contention of Mr. Choudhury is that once a plea is made and in regard to the plea because a dispute has been raised by the respondents by virtue of the written statement, it was required to be adjudicated and decided. The fresh vacancies advertised were not at issue before the Writ Court and, therefore, the writ petition could not have been disposed of in view of the recruitment process initiated subsequently.

8. Mr. D. Saikia, learned standing counsel, Government of Assam has drawn attention of the Court towards Paragraphs 3, 4 & 5 of the affidavit-in-opposition to say that the factual position has been clearly explained. The writ appellants have no case to succeed.

9. Having considered the facts and circumstances, and the pleadings towards which our attention has been drawn, we deem it relevant to extract Paragraphs 4 to 10 from the writ petition filed on behalf of the writ appellants/writ petitioners.

Paragraphs 4 to 10 of the writ petition reads as under:-

"4. That considering the fixed numbers district-wise vacancy many of the petitioners did not participate in the recruitment process as the chances of their selection were bleak considering the huge numbers of applicants who were participated on an all Assam basis. On the same premise, those petitioners who had participated in the recruitment process responding to the Advertisement dated 30.06.2017, did not carry out the mandatory verification of documents as required. It is relevant to state that there is no bar for a candidate to participate in any of the district, the only restriction being, the choice of District had to be singular.
5. That the result of the said recruitment process in context was declared on 01/09/2017 and the official website of SSA, this information was issued by the respondent authorities by Notification No. SSA/TT/Engagement of A T -
Page No.# 13/17 2017/1095/2017/2966 dated 01/09/2017.
A copy of the Notification dated 01/09/2017 is annexed herewith and the same is marked as ANNEXURE-B.

That by a Notification dated 06/09/2017 it was indicated, in substance, that 11,319 numbers of TET qualified candidates had been notified to be engaged as Assistant Teachers in respect of the advertisement dated 30/06/2017. As the petitioners were contemplating to participate for the post in the Lower Primary Level, the petitioners were surprised to notice that as against 7042 nos. of posts advertised in all for Lower Primary Level, Upper Primary - Social Science, and Upper Primary - Maths and Science, 11,319 candidates had been appointed against 'increased Vacancy'. This indicates that appointments to 11,319 nos. of posts have been made without any advertisement.

7. That the petitioners could arrange to collect two appointment orders dated 08/09/2017 and 08/09/2017 respectively. While one such order of appointment refers to the advertisement dated 30/06/2017 and indicates appointment on contractual basis in Pay-Band-2 Rupees 14000-49000/- and Grade Pay of Rs. 6200/- including other allowances as admissible to the State Government Employees, the other order of appointment indicated the Notification dated 06/09/2017 and also indicated such required for the period of 11 months at a fixed pay of Rupees 20000/- per month. The said persons so recruited initially for 11 a period of months with fixed monthly pay are still continuing in service and it is apparent that in the garb of a recruitment for 11 months, 11,319 candidates have been appointed as like regular service selectees.
A copy each of the orders dated 08/09/2017 and 08/09/2017 are annexed herewith and the same are marked as ANNEXURES-D and E, respectively.

That the recruitment of 11,319 nos of candidates for a period of 11 months in garb of such recruitment being in context with the advertisement dated Page No.# 14/17 30/06/2017 is illegal in as much as such recruitment of 11,319 nos. of candidates is on the different plank all together and not connected with advertisement dated 30/06/2017. Assuming but not admitting that such recruitment of 11,319 candidates is against 'increased vacancy', the respondent authorities are not enjoined under the law to fill up such huge nos of vacancies without notifying the same by way of separate advertisement so as to enable fair public participation.

That the action of the respondent authorities in facilitating back door entry of 11,319 candidates and that too as a different pay structure and length of service goes to show illegalities which have unarguably prevailed in recruiting 11,319 candidates depriving the chance of participation of the petitioners. Aggrieved by such illegal, arbitrary and discriminatory action of the respondent authorities which has affected the Fundamental Rights and Legal Rights of the petitioners, the petitioners are constrained to file the present Writ Petition.

That the petitioners are not challenging the recruitment of 7042 nos of candidates so appointed in context with the recruitment process initiated vide Advertisement dated 30/06/2017, but, are assailing the back door entry of 11,319 nos of candidates without any advertisement. As the Petitioners would have and are contemplating to offer their candidature(s) for the post of Assistant Teacher at Lower Primary Level, the Petitioners are restricting their challenge to 9731 candidates so appointed beyond 5854 Candidates at Lower Primary Level. As the numbers of such candidates in huge and the petitioners are in financial constraint, the petitioners pray that the Hon'ble Court be pleased to allow the petitioners to serve notice upon such 9731 candidates by way of paper publication -one English Daily and one Vernacular Daily having wide circulation in Assam, if need be, enabling them to contest the proceeding."

10. So far as the case set up on behalf of the State is concerned, we would like to extract Paragraphs 3, 4 & 5 of the affidavit-in-opposition, which is done here below:-

"3. That with regard to paragraph 2, 3, 11 and 12 of the writ petition the deponent begs to state that the Asom Sarba Siksha Abhiyan Mission had published advertisement for 7042 number of posts of contractual Assistant Teacher vide No.SSA/TT/Engagement of Asst. Teacher/1095/ 2017/1218 dated Page No.# 15/17 30-06-2017. In the advertisement it was clearly mentioned that the number of vacancy may increase.
In the meantime, a communication was received from Government of India vide Letter No.D.O. No.17-2/2017-EE.17, dated 03-08-2017 regarding last chance to acquire the requisite minimum qualification by elementary level teachers within 31st March, 2019. In the letter, broad strategy was mentioned to complete the training of untrained teachers by 31st March, 2019 as a last chance.
As 31st March, 2019 was the last date of acquiring professional qualification (2 year D.El.Ed/B.Ed etc.) by the elementary level untrained teachers, the matter was considered with utmost seriousness and considering the requirement of teacher in elementary level schools in the State, a decision was taken to fill up the 'State Pool of teachers' from the remaining eligible candidates in order of merit of the above mentioned engagement process on the basis of the provision mentioned in the advertisement dated 30-06-2017 i.e. 'number of vacancy may increase'.
This was done keeping in view the emergent situation that as the National Institute of Open Schooling (NIOS) registration for admission into the 2 years D.El.Ed was supposed to be closed on 15-09-2017. If the State Pool of teachers was to be filled up by fresh advertisement, it would not be possible to enrol the untrained Assistant Teachers of State Pool in NIOS within 15-09-2017. Considering the same, these teachers were engaged against State Pool on the basis of provision mentioned in the advertisement dated 30-06-2017 i.e. 'number of vacancy may increase'.
True copy of advertisement dated 30-06-2017 is annexed herewith and marked as Annexure-1.
True copy of Letter vide D.O. No.17-2/2017-EE.17 dated 03- 08-2017 is annexed herewith and marked as Annexure-2.

That with regard to paragraph 4 and 5 of the writ petition the deponent respectfully states that the entire process of engagement of 11319 Assistant Teachers under the scheme of 'Strengthening Elementary Education of Assam' was carried out against the advertisement No.SSA/TT/ Engagement of Asstt.
Page No.# 16/17 Teacher/1095/2017/1218, dated 30-06-2017 under the provision i.e. 'number of vacancy may increase'. The 11319 Assistant Teachers under State Pool were engaged so that these teachers can get themselves trained by enrolling themselves in the NIOS for 2 years D.El.Ed. programme by 15-09-2017.
5. That with regard to paragraph 6, 8, 9, 10 of the writ petition the deponent begs to state that a total numbers of 24345 candidates had submitted their online applications in response of the advertisement No.SSA/TT/Engagement of Asstt. Teacher/1095/2017/1218, dated 30-06-2017.
The Department of Elementary Education or Sarba Siksha Abhiyan, Assam is in no way responsible for non submission of online application by the petitioners of this case. As 24345 candidates had submitted online applications, the petitioner in this case could have also submitted their online applications against the said advertisement Non submission of online application by the petitioner is not the fault of Department of Elementary or Sarba Siksha Abhiyan, Assam, in as much as, no bar was imposed on the instant petitioners to participate in the process of appointment/engagement pursuant to the advertisement dated 30-06-2017."

Mr. Saikia, learned counsel for the State has very fairly stated, as a responsible officer of the Court, that indeed issue in facts, and in law was raised by virtue of Paragraphs 4 to 10 of the writ petition, extracted above, read in conjunction with Paragraphs 3, 4 & 5 of the affidavit-in-opposition, however, in view of subsequent developments was not adjudicated and decided. Mr. Saikia states that he would have no objection to remand of the matter for consideration of the issues raised in the writ petition by the learned Single Judge.

12. Considering peculiar facts and circumstances noted above and the stand of the learned counsels, we hereby dispose of this writ petition while remanding the matter to the learned Single Judge for fresh adjudication. Consequently the impugned order dated 22.01.2020 is set aside.

Needless to say that this Court is not recording any opinion on facts, or in law on any of the issues raised by the learned counsels. We have referred to the pleadings Page No.# 17/17 from the writ petition and the counter affidavit only to highlight the contention of learned counsel for the writ appellants/writ petitioners, as noted above.
