For the Company The Court : Mr. Mitra learned counsel for the petitioner submits that in spite of directions for exchange of affidavits having been given, the company has not filed any affidavit in opposition. Further, insolvency proceeding has been initiated against the company before the NCLT. The Insolvency Resolution Professional has invited claims from the creditors of the company. The petitioner has also lodged its claims with the insolvency IRP.
Mr. Mitra submits that this winding up petition should stand transferred to the NCLT.
Mr. A. Roy appearing on behalf of the company strongly opposes the prayer for transfer.
I find no urgency in the matter.
List the matter before the regular Bench.
