ORDER:(per Hon'ble Sri Justice A.Rajashekeer Reddy, J) This Commercial Civil Appeal is filed against exparte interim order dated 04.06.2020 in COP No.24 of 2020 passed by the XXIV Additinoal Chief Judge-cum-Commercial Court, City Civil Court, Hyderabad.
Heard Sri Surya Narayana Yellampanthulu, learned counsel for the appellants and Sri S.Niranjan Reddy, learned Senior Counsel appearing for Rubaina S.Kathoon, learned counsel for the respondent.
After hearing Sri Surya Narayana Yellapanthulu, learned counsel for the appellants, since appeal is against an exparte interim order, we are of the opinion that the appellants can approach the Court below by filing counter and petition for vacating the said order and raise all the contentions raised herein before the Court below and that no extraordinary circumstances are pointed to us for entertaining the appeal against exparte interim order.
Therefore, without expressing any opinion on merits of the case, this Appeal is disposed of granting liberty to the petitioners to move the Court below for vacation of the order.
Since the learned counsel for the appellant expressed urgency in the matter, the Court below is directed to dispose of the application as expeditiously as possible, preferably within a period of two months from the date of filing counter and vacate petition before the Court below.
There shall be no order as to costs. As a sequel thereto, miscellaneous applications, if any, pending in this appeal, shall stand closed.
