ORAL ORDER
2 17-10-2023Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehend her arrest in connection with Harsidhi P.S. Case No. 293 of 2022, dated 23.06.2022, registered for the offence punishable under Sections 406, 420, 467, 468, 471 of the Indian Penal Code.
3. The case of prosecution, in short, is that the present F.I.R. has been lodged on the basis of letter dated 22.06.2022 of Secretary of Panchayat Teacher Employment Unit -cum- Panchayat Secretary, Gram Panchayat Raj, Mathlohiyar Harsidhi against the petitioner. It is alleged that after counselling of Teacher Employment in Gram Panchayat Raj Mathlohiyar in the year 2019-2020, CTET/BTET certificates submitted by the Patna High Court CR. MISC. No.65377 of 2023(2) dt.17-10-2023 2/3 petitioner during course of verification has been found forged.
4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. The petitioner was not appointed on the basis of alleged false documents and no wrong has been caused to the Department. It is also submitted that without any notice or show cause, the said F.I.R. has been lodged. The petitioner is woman. She got no benefit from the Government. The petitioner has clean antecedent. It is further submitted that similarly situated person with similar allegations regarding production of forged C.T.E.T./B.T.E.T. certificate which was subsequently found as forged has already been granted anticipatory bail vide Cr. Misc. No. 64210 of 2022 by a Coordinate Bench of this Court in connection with Gobindganj (Malahi) P.S. Case No. 337 of 2022.
5. Learned A.P.P. for the State has vehemently opposed the prayer for bail to the petitioner.

Having considered the facts and circumstances of the case and the submissions of learned counsel for the parties, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like Patna High Court CR. MISC. No.65377 of 2023(2) dt.17-10-2023 3/3 amount each to the satisfaction of learned C.J.M., Motihari, East Champaran in connection with Harsidhi P.S. Case No. 293 of 2022, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
