Mitra ... for the State-respondents Let the affidavit of service filed in court today be kept with the record. The petitioner appeared at the B.Sc. Part-III (Honours) Examination, 2013 from the University of Kalyani. He was placed in the second class. He was not satisfied with the marks obtained by him. Pursuant to an application under the provision of the Right to Information Act, inspection of the answer scripts was allowed to him. He makes a grievance that he has not been awarded marks according to his assessment. I am afraid that the Court perhaps had to do about it. Although learned Advocate for the petitioner submits that the petitioner had also filed an application for re-examination there is no averment to that effect in the writ petition nor has any copy of the receipt for deposit of the fees has been annexed to the writ petition. 2 Be that as it may, if the petitioner has really filed any application for re-examination and if the same be within time, the University authorities are directed to publish the result thereof in accordance with the Rules relating to the re-examination of answer scripts as well subject to his eligibility for the same.
The writ petition is disposed of.
There shall be no order as to costs.
Since the writ petition is being disposed of without annexing any affidavit, all allegations made therein are hereby denied.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties as early as possible upon compliance of all requisite formalities.
