UPON hearing the counsel the Court made the following
O R D E R
1 Permission to file the Special Leave Petition is granted. 2 The High Court at Calcutta is in seisin of the proceedings and the next date of listing is 10 January 2023 in terms of the order dated 16 December 2022. 3 The petitioner would be at liberty to move the High Court for being heard in the pending proceedings. We permit the petitioner to do so. 4 In this view of the matter, it is not appropriate for this Court to exercise its jurisdiction under Article 136 of the Constitution at this stage. 5 The Special Leave Petition is accordingly dismissed. 6 Pending applications, if any, stand disposed of.
