ORAL ORDER
4 11-02-2013In the counter affidavit filed on behalf of the State it is stated that the contract in question has already been given to the successful bidder and agreement with successful bidder has also been entered on 4.1.2013 and the work order has already been issued to the contractor and he has started the work in full swing.
If that be so, it appears to be a case of willful violation of the order dated 17.1.2013 of this Court by which status quo as of today was directed to be maintained.
Learned counsel for the petitioner prays for a short adjournment so that he may file an interlocutory application for impleading the contractor who has been issued the work order as party to the present writ application.
As prayed for, put up on 18th February, 2013 among top ten cases.
In the meantime, learned counsel for the State shall also file a supplementary counter affidavit indicating the details regarding the date on which the work order has been issued and the progress made in the work after 17.1.2013.
