49 20-08-2018Learned counsel for the parties have assisted the Court.
Re.: Interlocutory Application No. 6314 of 2018
2. The Interlocutory Application No. 6314 of 2018 has been filed in C.W.J.C. No. 5192 of 2015, for declaring resolution of the State Government in the Finance Department as contained in Resolution No. 582 dated 17.07.2018, to be inapplicable for the purpose of deciding the issue involved in the writ application being an executive instruction which cannot be applied with retrospective effect.
3. As the aforesaid resolution of the State Government is directly on the issue involved in the present case, the amendment sought of additional relief through the Interlocutory application stands allowed. The same shall form part of the main writ application.
4. Interlocutory Application No. 6314 of 2018 stands disposed off.

5. In view of Interlocutory Application No. 5994 of 2018 filed in C.W.J.C. No. 4791 of 2016; Interlocutory Application No. 5990 of 2018 filed in C.W.J.C. No. 10165 of 2017; Interlocutory Application No. 5991 of 2018 filed in C.W.J.C. No. 10348 of 2017; Interlocutory Application No. 6110 filed in C.W.J.C. No. 6587 of 2017 and Interlocutory Application No. 6383 of 2018 filed in C.W.J.C. No. 2081 of 2017, in the same terms, the same also stand allowed. However, in all the present batch cases, the resolution of the State Government dated 17.07.2018 shall also be deemed to be under challenge irrespective of whether individual amendment has been sought or not.
Re. Civil Writ Jurisdiction Case No. 5192 of 2015 and analogous cases
6. Having considered the matter, as the State Government has taken a conscious decision culminating in resolution dated 17.07.2018, specifically in terms of C.W.J.C. No. 15607 of 2016, which is part of the present batch cases, after taking note of all the relevant resolutions/circulars on the issue, which admittedly are the basis of the claim of the petitioners, and thereafter, by way of clarification, holding that the relief cannot be granted for various reasons, the Court finds that such Patna High Court CWJC No.5192 of 2015 (49) dt.20-08-2018 19 /19 resolution has to be considered by the Court before any relief can be granted to the petitioners in the present case.
7. In view of the present dispensation of allotment of matters required to be placed before various benches of the Court, the challenge to any resolution of the State Government is to be placed before the appropriate Division Bench.,
8. Accordingly, the matters be placed before the appropriate Division Bench after permission of Hon'ble the Chief Justice.
9. The parties are at liberty to mention the matters for early listing/hearing.
10. For such purpose, let learned counsel for the parties file legible copies of their pleadings within two weeks from today.
