O.M.P.(I) (COMM.) 68/2023 The learned counsel appearing for the petitioner, after some length of arguments on merits of the case, has made a prayer that in terms of prayer "C‟ of the petition, the respondent may be directed to furnish 10 days‟ prior notice to the petitioner in the event it seeks invocation of the Bank Guarantee bearing No. 36600IGL0015220 in pursuance of the termination Signature Not Verified Digitally Signed By:DAMINI YADAV Signing Date:04.03.2023 15:02:29 order 14th February, 2023, the respondent may be directed to give the petitioner 10 days‟ prior notice.

Heard, the learned counsel appearing for the petitioner. In view of the above facts and circumstances and the prayer made on behalf of the petitioner, as the matter is not pressed by the petitioner on merits at this stage, on an oral request made by the learned counsel appearing for the petitioner, the respondent is directed to give a 10 days‟ prior notice to the petitioner before invoking the bearing No. 36600IGL0015220 in pursuance of the termination order 14th February, 2023 as detailed in part „C‟ of the prayer to the petition.

Accordingly, the petition is disposed of.
