FACTS :
This matter is called for hearing today dated 7.3.2011. Appellant present along with Advocate Amit Jha. HSCL is represented by Shri S.C. Singh, Sr RM, HSCL. The parties are heard and the records perused.
2. It is the grievance of the appellant that he was a petty contractor for Triveni Structural Ltd, Allahabad, the latter being a sub-contractor for HSCL. It is his grievance that the machinery and equipment belonging to him was taken over by HCSL through TSL some time in 1970 and that neither the equipment/machinery has been restored by TSL/HSCL during last 04 decades nor hire charges paid to him. In this connection vide RTI application dated 16.1.2010, he had sought information from HSCL on 12 paras. Dissatisfied with the response of the CPIO and AA, he has filed the present appeal.
3. On the other hand, Shri S.C. Singh submits that HSCL had no connection whatsoever with the appellant and admittedly, the appellant was a petty contractor of TSL. Hence, it is a matter between the appellant and TSL and HSCL does not come into the picture.
4. Suffice to say that both TSL and HSCL are PSUs of the Central Government and, therefore, are public authority in terms of section 2 (h) of the RTI Act. Both of them are required to respond to legitimate queries of the appellant. However, it is noticed that the queries raised in the RTI application are not specific/pointed. In the premises, the appellant is asked to reframe the queries seeking pointed/specific information from TSL/HSCL whereupon notice will be issued to the parties for hearing and decision.
5. The matter is adjourned.
