COMMON ORDER:

In both these writ petitions, the petitioners who have been granted scholarship to study abroad under the Videshi Vidhya Deevana Scheme had proceeded abroad to pursue their studies on the basis of the sanction granted to them. It is stated that the petitioners were also given the first instalment of Rs.5,00,000/- out of the sum of Rs.10,00,000/- granted to the petitioners.

2. The petitioners have now approached this Court with the complaint that the second instalment is not being paid despite various requests being made to the authorities.

Sri N.Sri Hari, learned Standing Counsel for Andhra Pradesh State Kapu Welfare and Development Corporation, after obtaining instructions had submitted that the second instalment was stopped on account of verification being carried out by the Vigilance Department, at the request of the Corporation.

The learned Government Pleader for General Administration has now placed a brief note submitted by the Deputy Inspector General of Police in the office of the Director 2 General, Vigilence and Enforcement and Ex-Officio Principal Secretary to Government of Andhra Pradesh. In this report, it is stated that, an enquiry was conducted in relation to the petitioners in these two writ petitions and it was found that they do not suffer from any ineligibility.

5. In view of the said report, there is no reason why the Andhra Pradesh State Kapu Welfare and Development Corporation should deny the rightful claim of the petitioners. It is submitted that in the case of W.P.No.3780 of 2023, the petitioner had not received any amount out of the grant of Rs.10,00,000/- and the cost of the air tickets and visa charges. The petitioners in W.P.No.1537 of 2023 also claim that the visa charges and ticket expenses have not been given.

6. In the circumstances, these writ petitions are disposed of with the following directions:-

i. The writ petitioner in W.P.No.3780 of 2023 shall be paid the entire sum of Rs.10,00,000/- along with air fare and visa charges within a period of six (06) weeks from the date of receipt of this order. ii. The petitioners in W.P.No.1537 of 2023 are to be paid the second instalment of Rs.5,00,000/- within a 3 period of six (06) weeks from the date of receipt of this order.
iii. Since, there is a dispute as to whether the ticket fare and visa charges were paid to the petitioners in W.P.No.1537 of 2023, the Andhra Pradesh State Kapu Welfare and Development Corporation shall ascertain whether such payment has been made or not and make necessary payment, if any amount is found to be due. This exercise shall also be completed within six (06) weeks from the date of receipt of this order. There shall be no order as to costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
