Information sought:
1. The Appellant filed an RTI application (offline) dated 09.10.2023 seeking the following information:
"1. रोजगार सं० CEN 01/2019 के तहत जो sr. clerk cum typist (SCCT, वरर० लिपिक) एवं junior clerk cum typist (JCCT, कनि० लिपिक), जो फिरोजिुर मंडि के लिए भेजे गये हैं उिकी योग्यता क्रम (merit लिस्ट) फक मूि प्रनत की PDF whatsapp no. 95173-67673 िर दें ।Page 1 of 8
2. सभी शाखा में कायाािय अधीक्षक (OS) के LDCE कोटे के फकतिे फकतिे िोस्ट खािी हैं एवं अन्य में फकतिे कृिया इिकी सूचि प्रदाि करें ।
3. सभी शाखा में Sr.Clerk cum typist के LDCE कोटे के फकतिे फकतिे िोस्ट खािी हैं एवं अन्य में फकतिे कृिया इिकी सूचि प्रदाि करें ।
4.. रोजगार सं० CEN-01/2019 के तहत जो sr. clerk cum typist (SCCT, वरर० लिपिक) एवं junior clerk cum typist (JCCT, कनि० लिपिक), जो फिरोजिुर मंडि के लिए भेजे गये हैं उिकी िदोन्िनत ब्ांि के आधार िर की जायेंगी या उिकी योग्यता क्रम (merit लिस्ट) के आधार िर कृिया इस सम्बन्ध में नियम (Policy) सहहत सुििा प्रदाि करें ।"
2. The CPIO furnished a reply to the Appellant on 06.11.2023 stating as under:
"1. Indian Railway Employment notification no. CEN 01/2019, Sr. Clerk/Level-5 and Jr. Clerk/Level-2 panel received in Firozpur Division, Northern Railway photocopy enclosed with this letter.
2. At present total 55 post (All department) vacant against 20% LDCE quota for Office Superintendent/Level-6 post.
3. At present total 8 vacancy (All department) vacant against 13-1/3% LDCE quota for Sr. Clerk/Level-5 post.
4. i) Sr. Clerk/Level-5, promotion to higher post OS/Level-6 will be done by 80% seniority cum suitability(bench marking) and 20% LDCE selection.
ii) Jr. Clerk/Level-2, promotion to higher post Sr. Clerk/Level-5 will be done by 66-2/39 seniority cum written suitability, 13-1/3% LDCE selection and Office Superintenden /Level-6 post against 20% LDCE selection."
3. Being dissatisfied, the appellant filed a First Appeal dated 01.12.2023. The FAA vide its order dated 29.12.2023, held as under.
"1. भारतीय रे िवे रोजगार अचधसूििा क्रमांक, सीईएि 01/2019, उत्तर रे िवे के फिरोजिुर डडवीजि में सीनियर क्िका िेवि-5 और जूनियर क्िका/िेवि-2 का िैिि िहिे ही आिको भेजा जा िुका है । हािांफक, इसकी िोटोकॉिी िुिः इस ित्र के साथ संिग्ि कर भेजी जा रही है ।
2. एवंम ् 3 पवभाचगय आधार िर कायाािय अचधक्षक िेवि 06 (80 प्रनतशत, PQ & 20% LDCE Quota) एवम ् वररष्ठ लिपिक (66-2/3% PQ, 20% DRQ & 13-1/3% LDCE quota), फिरोजिुर मंडि उत्तर रे िवे में ररक्क्त क्स्थनत निम्िुसार हैं-

4. िदोन्िनत भारतीय रे िवे स्थािि महावाषक (आईआईएम) खंड-1 के प्रवधाि के
अिुसार शालसत होती है। सावाजनिक डोमेि में उििब्ध है और वेबसाइट
indianrailways.gov.in िर एक्सेश फकया जा सकता है । सूििा के लिए आंकड़ों का
पवश्िेषण करिे, निवमी को समझािे और पवलभन्ि स्रोत़ों से सवाि की आवश्यकता होती है जी आरटीई के दायरे से बाहर है।"
4. Feeling aggrieved and dissatisfied, appellant approached the Commission with the instant Second Appeal.
Relevant Facts emerged during Hearing:
5. The following were present:-
Appellant: Present through VC.
Respondent: Shri Bijender Kumar, CPIO-cum-DPO, attended the hearing through VC.
6. The Appellant stated that the Respondent has not provided the relevant policy sought by him in point No. 4 of the RTI Application.
7. The Respondent submitted that a suitable and pointwise reply qua the instant RTI Application has been given to the Appellant vide letter dated 06.11.2023 and 29.12.2023. He added that the information sought by the Appellant in point No. 4 of the RTI Application is available on the website.
Page 4 of 88. The Appellant interjected and apprised the Bench that the Respondent is trying to mislead the Bench because the fact in respect of point No. 4 of the RTI Application is that the averred policy is not available on their website.
9. A written submission has been received from Shri Bijender Kumar, CPIO-
cum-DPO, vide letter dated 02.05.2025, a copy of which has been sent to the Appellant and the same has been taken on taken on record. The relevant extract of the same is as under:
"In reference to the above, it is submitted that your RTI Registration Number NRFZD/R/E/23/00524 dated-09.10.2023 (Copy attached) desired information is as under:-

Replied vide this office letter no. NR-FZROPERS (MISC)/62/2022- O/oSr.DPO/FZR/NR dt. 06.11.2023 (Copy attached) as under:-
1. Indian Railway Employment notification no. CEN 01/2019, Sr.Clerk/Level-5 and Jr. Clerk/Level-2 panel received in Firozpur Division, Northern Railway photocopy enclosed with this letter.

आिसे पविम्र अिुरोध है फक उिरोक्त सन्दभा में प्राथी को जो सूििा 08.11.2023 उििब्ध कराई गयी थी वो िूणा िहीं है । अतः निम्िांफकत सुििा को संशोचधत करके िुिः सुििा प्रदाि करें ।
1. रोजगार स० CEN 01/2019 के तहत जो Sr. Clerk Cum Typist (SCCT, वरर० लिपिक) एवं Junior Clerk Cum Typist (JCCT, कनि० लिपिक), जो फिरोजिुर मंडि के लिए भेजे गये है उिकी योग्यता क्रम (Merit List) की मूि प्रनत की PDF whatsapp no. 95173-67673 िर दें ।
क्रम स. 01 के सम्बन्ध में संसोधि- उिरोक्त कमािारी का केवि कम सं० को दशााया गया है िरन्तु उिके योग्यता क्रम (Merit List) को िहीं दशााया गया है । कृिया उिरोक्त कमािारी की वरीयता क्रम भी प्रदाि की जाये।
2. सभी शाखा में कायाािय अधीक्षक (OS) के LDCE कोटे के फकतिे फकतिे िोस्ट खािी है एवं अन्य में फकतिे हैं कृिया इिकी सूिी प्रदाि करें । क्रम में 2 के सबंध में - इस सम्बन्ध में केवि कायाािय अधीक्षक (OS) के LDCE कोटे के िोस्ट को दशााया गया है अन्य के िहीं (80% general कोटा को िहीं दशााया गया जबफक प्राथी के द्वारा सभी शाखा (ब्ांि के हहसाब) से सूििा मांगी गयी थी उिरोक्त सुििा बाि के हहसाब से गणिा करके िहीं दी गयी। अतः प्राथी को क्रम से 2 के सम्बन्ध में िूणा सूििा प्रदाि की जाये।
3. सभी शाखा में Sr. Clerk cum typist के LDCE कोटे के फकतिे फकतिे िोस्ट खािी है एवं अन्य में फकतिे कृिया इिकी सूिी प्रदाि करे । क्रम सः 3 के सम्बन्ध में संसोधि- इस सम्बन्ध में केवि Sr. Clerk Cum Typist के LDCE के िोस्ट को दशााया गया है अन्य के िहीं (66-2/3% promotional कोटा 20% सीधी भती के िद को िहीं दशााया गया), जबफक प्राथी के द्वारा सभी (ब्ांि के हहसाब) से सूििा मांगी गयी थी, उिरोक्त सूििा ब्ांि के हहसाब से गणिा करके िहीं दी गयी। अतः प्राथी को उिरोक्त क्रम से 3 के सम्बन्ध में िूणा सूििा प्रदाि की जाये।
4.. रोजगार सं० CEN-01/2019 के तहत जो sr. clerk cum typist (SCCT, वरर० लिपिक) एवं junior clerk cum typist (ICCT, कनि० लिपिक), जो फिरोजिुर मंडि के लिए भेजे गये हैं उिकी िदोन्िनत ब्ांि के आधार िर की जायेंगी या उिकी योग्यता क्रम (merit लिस्ट) के आधार िर कृिया इस सम्बन्ध में नियम (Policy) सहहत सूििा प्रदाि करें ।
Page 6 of 8क्रम सं 4 के सम्बन्ध में प्राथी के द्वारा सुििा मााँगा गया था की sr. clerk cum typist (SCCT, वरर० लिपिक) एवं junior clerk cum typist (JCCT, कनि० लिपिक), जो फिरोजिुर मंडि के लिए भेजे गये हैं उिकी िदोन्िनत ब्ांि के आधार िर की जायेंगी या उिकी योग्यता क्रम (merit लिस्ट) के आधार िर कृिया इस सम्बन्ध में नियम (Policy) सहहत सुििा प्रदाि करें । उिरोक्त सम्बन्ध में प्राथी को ये स्िष्ट िहीं फकया गया फक उिरोक्त कमािारी फक िदोन्िनत ब्ांि के आधार िर होगी या उिकी योग्यता क्रम (Merit लिस्ट जो RRB के द्वारा प्रदाि फकये गये) के आधार िर एवं इस सम्वन्ध में कोई िालिसी भी प्राथी को िहीं प्रदाि की गयी। कृिया क्रम सं० 4 की सूििा स्िष्ट रूि से प्रदाि करें एवं िालिसी भी प्रदाि करें ।

Decision:
10. The Commission, after adverting to the facts and circumstances of the case, hearing both the parties and perusal of the records, observes that a suitable reply in respect of point No. 1 to 3 of the RTI Application has been given to the Appellant. However, with respect to point No. 4 of the RTI Application, the reply provided by the Respondent is not satisfactory as no policy is available on their website. Accordingly, the CPIO is directed either to provide CTC of specific policy to the Appellant as sought in point No. 4 of the RTI Application or if the information is available on their website, then provide to the Appellant the relevant URL with complete path leading up to the specific document, within two weeks from the date of receipt of this order.
11. The FAA to ensure compliance with the above direction.
The appeal is disposed of accordingly.
