"a) Direct the Respondent No. 1 to allow the candidates an extension to join the post of Insurance Medical Officer Grade -- II in which they were shortlisted after clearing the examination for Insurance Medical Officer Grade -- ll, 2021 and allow them to join as and when the vacancy arise after they complete their post graduate course (in terms of list which is annexed as "Annexure - P-11" with the present application);
b. pass such further order(s) as may be deemed fit and proper in facts and circumstances of the present case, in the interest of justice."
2. Initially, the applicant had approached the Hon'ble Apex Court, and the same was disposed of by the following order:
"1) Learned senior counsel for the petitioner seeks permission to withdraw this writ petition with liberty to approach before appropriate forum.
2) Accordingly, the writ petition stands dismissed as withdrawn with the aforesaid liberty."
3. Thereafter, it is not in dispute that the applicant approached the Hon'ble High Court in W.P.(C) 2832/2025, which was disposed of by order dated 06.03.2025, wherein liberty was granted to the applicant to approach this Tribunal.

4. Based on the said liberty, the present applicants have approached this Tribunal. The sum and substance of the arguments advanced by the learned counsel for the applicant is that since July 2024, the applicants have been pursuing an alternative remedy by way of representations in their individual cases, seeking an extension of the joining date. The reasons assigned for seeking an extension are largely common, primarily on the ground that the NEET-PG course is ongoing, and due to a delay in the selection process, they are required to discontinue the course midway.

Learned counsel for the applicant has drawn attention to the respective representations, wherein it has been contended that the primary issue raised in the application is also reflected in the individual representations. By way of illustration, reference is made to the representation of Applicant No. 1, Ms. Gopika Krishnan, which reads as under:
"I am writing to express my sincere willingness to join the post of Insurance Medical Officer (IMO) Grade-II at Employees State Insurance Corporation (ESIC). I am honored to have received the appointment letter dated 30-07-2024 (copy attached), specifying my joining at [DIRECTORATE (M), New Delhi] I am very enthusiastic about this role and am eager to contribute to your esteemed organization. However, as I am currently pursuing my post-graduate studies in General Medicine at NORTHERN RAILWAY CENTRAL HOSPITAL NEW DELHI, which require my 25 item No. 8/C-4 OA No. 1013/2025 full attention and commitment, it is challenging for me to commence my duties as an IMO at thi time. I applied for the IMO posit in 2021 and appeared for the exam in 2022, but due to the delay in results, I was able to clear the PG entrance test and subsequently started my post-graduate studies.
In light of the demanding nature of my academic and clinical responsibilities, I respectfully request an extension of my joining date until NOVEMBER 2025. This additional time will allow me to complete my post-graduate studies and ensure that I can fully dedicate myself to the role of Medical Officer once my studies are concluded.
I remain fully committed to joining (Directorate M, New Delhi) and contributing effectively to your organization. I arm confident that this extension will enable me to meet my academic obligations while preparing thoroughly for the role, allowing me to provide the highest standard of care and make a meaningful contribution to your organization. I would greatly appreciate your understanding and consideration of my request. Please let me know if any additional documentation or information is needed. I am available at your convenience to discuss this matter further or address any questions you may have."
6. The reasons assigned in the respective individual representations are largely similar, with some applicants seeking an extension of the joining date until November 2025 or December 2025. Learned counsel for the applicant has also drawn attention to Annexure A/7, wherein RTI information is provided as follows:

7. Learned counsel appearing on advance notice on behalf of the respondents submits that the present OA is premature, as the respondents have not yet taken a decision on the pending representations. He further 26 item No. 8/C-4 OA No. 1013/2025 submits that the respondents wish to place on record their reply in this regard.

It is further contended by the respondents that, as a matter of principle and rule, the maximum permissible period for extension is six months, and any further extension cannot be claimed as a matter of right, as it would affect the functioning of health services, including those of the respondents. However, from Annexure A/7, it is evident that out of 263 candidates who applied for an extension, only 76 candidates have been granted an extension of joining for various reasons and different durations.

In view of the foregoing, we direct the respondents to consider and decide the representations of the applicants on case to case basis by taking a holistic view of the matter, particularly in light of the fact that 76 out of 263 candidates have already been granted an extension. The Competent Authority shall dispose of the representations by passing a reasoned order, taking into account the same analogy applied to those who have already been granted an extension. Such a decision shall be made within a period of six weeks from the date of receipt of a certified copy of this order.

10. Needless to say, we do not enter into the merits of the case, and this order is passed without prejudice to the rights and contentions of either party. In the event that a reasoned order is passed in favour of any applicant, consequential relief may follow within 45 days' thereafter.
11. In light of the above, the present OA stands disposed of. There shall be no order as to costs. Consequently, the pending Miscellaneous Application (MA) also stands disposed of.
