All cases listed today have been taken up for hearing by way of video conferencing because of the situation existing due to the COVID-19 pandemic.

By this petition, the petitioner seeks the concession of ' interim regular bail', under the provisions of Section 439 of the Cr.P.C., upon FIR no.132, dated 09.07.2017, having been registered at Police Station Bawani Khera, District Bhiwani, alleging therein the commission of offences punishable under Sections 147, 148, 149, 323, 341, 325, 307, 302, 212, 506 of the IPC, as also Section 25 of the Arms Act, 1959.

Learned counsel for the petitioner submits that the petitioner is one amongst 55 people named as accused in the FIR and he has been in custody for about 3 years and is now seeking interim bail to attend the ring and marriage 1 of 2 ::: Downloaded on - 02-12-2020 21:38:20 ::: CRM-M-39370 of 2020 -2- ceremony of his two daughters on 06.12.2020 and 11.12.2020.

Upon query to learned State counsel, he submits that though there is no other criminal case registered against the petitioner as per his instructions, however, other than the fact that two persons were murdered in the occurrence in question, subsequently even a witness to the occurrence was murdered.

As regards the petitioner being one amongst 55 persons named as accused, he obviously does not deny that even in term of the FIR.

Without making any comment on the actual merits of the case, the petition is allowed, with the petitioner ordered to be admitted to interim bail from 04.12.2020 till 17.12.2020, with him to surrender before the jail authorities on 17.12.2020 by 5:00 p.m. He would furnish bail bonds in the sum of Rs.50,000/- and two sureties in the like amount and further comply with all conditions imposed to the satisfaction of the CJM/Duty Magistrate concerned.
