1. Heard learned counsel for the petitioner through video conferencing. Learned Public Prosecutor is present in Court

2. Petitioner has filed this bail application under Section 439 of Cr.P.C.

3. F.I.R. No. 170/2015 was registered at Police Station Ramgarh(Alwar) for offences under Section 8 of R.B. Act and Section 16/54 of Raj. Excise Act.

4. It is contended by counsel for the petitioner that petitioner was not arrested from the place of occurrence. It is also contended that petitioner is not having any criminal antecedents.

5. Learned Public Prosecutor has opposed the bail application.

7. Considering the contentions put forth by counsel for the petitioner, I deem it proper to allow the bail application.

8. This bail application is accordingly allowed and it is directed that accused petitioner shall be released on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only), with a further direction to submit two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) before the concerned Court within four weeks after the withdrawal of the order of the lock-down.

9. If the aforesaid two sureties are not submitted within the aforesaid period, Court below would be free to initiate appropriate action against the petitioner.
