3. The present petition is filed under Section 482 of the Code of Criminal Procedure, 1973, inter alia, praying for quashing of complaint and proceedings arising out of CC No. 35841/2016 titled as M/s Adigear International v. M/s Lilliput Kidswear Ltd. & Ors., under Section 138 read with Section 141 of the Negotiable Instruments Act, 1881, pending before the learned Metropolitan Magistrate, NI Act, Patiala House Court, Delhi, as of today.
4. The learned counsel for the petitioner submits that cheque was issued on 15.02.2012 by the accused company. He submits This is a digitally signed order.

The Order is downloaded from the DHC Server on 19/02/2024 at 23:03:42 that the petitioner is not a signatory to the said cheque and had, in fact, resigned from the accused company on 12.09.2011.
5. The petitioner relies upon Form 32 under the Companies Act, 1956 evidencing the fact that the petitioner had retired with effect from 12.09.2011.
6. Issue notice. Notice be served through all permissible modes.
7. In the meantime, the learned Trial Court is directed not to proceed against the petitioner till the next date of hearing.
