2 23-08-2013Heard learned counsels for the petitioner and the State.
The petitioner is languishing in custody since 21.03.2013 in a case registered for the offences punishable under Sections 121 (A), 122 of the Indian Penal Code, Sections 25(1- A), 26(1) (ii), 35 of the Arms Act, Sections 3/4/5 of the Explosive Substances Act and Section 17 of Criminal Law Amendment Act.
Huge quantity of R.D.X powder and other arms and ammunitions were recovered which were concealed with the leafs of the tree. The petitioner along with seventeen others were named on the basis of vague statement of the villagers.
It is also submitted by the learned counsel for the petitioner that nothing has been recovered from the possession of the petitioner nor the petitioner has been put on test identification 2 Patna High Court Cr.Misc. No.29526 of 2013 (2) dt.23-08-2013 2/2 parade. A statement has been made in paragraph-3 of the petition that apart from the present case, the petitioner has been made accused in five other cases out of which the petitioner has been granted bail in two cases.
Considering the nature of recovery and period under custody, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Kharagpur P. S. Case No. 33 of 2010 Considering the fact that the petitioner is accused in five other cases the learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner gets involved in some serious offence or defaults without any reasonable cause on two consecutive occasions.
