The petitioner is seeking anticipatory bail in FIR No. 0185 dated 20.08.2020, under Section 306 read with Section 34 of the Indian Penal Code, 1860 ('IPC' - for short) (FIR was registered under Section 302/34 IPC), registered at Police Station Julana, District Jind.
Learned counsel for the petitioner contends that it is alleged that the daughter-in-law of the petitioner had consumed poison after 8-9 years of marriage and she was taken to the hospital promptly by the petitioner and other family members. The son of the petitioner had expired three months prior to the incident due to which the daughter-in-law of the petitioner was depressed. The grandson of the petitioner, who is the stepson of the deceased, has been arrested in the case. He also contends that the allegations against the petitioner would not constitute a prima facie case against the petitioner. He also contends that the petitioner is 73 years of age and is suffering from various ailments including heart related ailments. pertaining to the medical treatment of the petitioner in PGIMS, Rohtak at Annexures P3 to P5.
This Court, by order dated 11.02.2021 had directed the petitioner to appear before the Investigating Officer and join the investigation and in the event of his arrest, he was ordered to be released on ad-interim bail to the satisfaction of the Investigating/Arresting Officer, subject to the conditions envisaged under Section 438(2) Cr.P.C.
Learned State counsel, upon instructions from ASI Ashok, states that the petitioner has joined investigation.
In view of the above and the petitioner having joined investigation, the Covid-19 Pandemic, the order dated 11.02.2021 granting interim bail to the petitioner is made absolute.
However, the petitioner shall abide by the conditions stipulated under Section 438(2) Cr.P.C. He shall also join investigation as and when called upon to do so.
The petition stands disposed of.
