ORAL ORDER
4 11-04-2023Heard learned counsel for the petitioner, learned APP for the State as well as learned Senior Counsel appearing on behalf of North Bihar Power Distribution Company Limited (NBPDCL).
The petitioner apprehends his arrest in connection with Govindganj (Areraj) P.S. Case No.238 of 2022, registered for the offences punishable under Sections 406, 420 and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the petitioner has got no criminal antecedents as stated in paragraph-3 of the bail petition. Patna High Court CR. MISC. No.58806 of 2022(4) dt.11-04-2023 2/2 It is further submitted that the informant and witness of the FIR, namely, Chandrakant were suspended on 19.05.2022 for loss of revenue and for their illegal act. Thereafter on 20.05.2022, the informant lodged this false case against the petitioner. It is submitted that the petitioner is not responsible for old dues, rather employees of NBPDCL are responsible for meter reading.
Learned APP for the State as well as learned Senior Counsel appearing on behalf of NBPDCL opposed the prayer for grant of anticipatory bail to the petitioner.
Taking into consideration the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Motihari, East Champaran in connection with Govindganj (Areraj) P.S. Case No.238 of 2022, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
