1. This is an Application filed under Order XXXIX Rule 4 of the Code of Civil Procedure, 1908 ("CPC"), for vacation / modification of the ex-parte ad-interim order dated 22.09.2025.
2. Issue Notice. The learned Counsel for the Plaintiff accepts Notice.
3. Let the Reply be filed within a period of four weeks. Rejoinder thereto, if any, be filed within a period of two weeks thereafter.
I.A. 27196/20254. This is an Application filed under Order VII Rule 11 read with Section 151 of the CPC for rejection of the Plaint.

7. List along with I.A. 27194/2025 on 23.01.2026, the date already fixed.
I.A. 27195/20258. This is an Application filed under Section 151 of the CPC for release and return of the devices seized by the learned Local Commissioner during the Local Commission conducted on 29.05.2025.
9. The learned Counsel for the Defendant submits that during the Local Commission conducted on 29.05.2025, the learned Local Commissioner has taken the possession of the following electronic devices:
a. One (1) Laptop - MacBook / HP / Dell b. One (1) Mobile Phone (Brand/Model); c. One (1) External Hard Drive; d. One (1) Pen Drive;
e. Other ancillary storage media and documents.
10. The learned Counsel for the Plaintiff submits that the Plaintiff has no objection for the return and release of the Defendant's devices seized by the learned Local Commissioner as the inspection has already been completed and the Report has been submitted before this Court, provided that the Defendant does not dispute the genuineness of the documents extracted from these devices and annexed along with the Report of the Local Commissioner filed before this Court.
11. While reserving the rights and contentions of the Parties, the Defendant's devices being one (1) Laptop - MacBook / HP / Dell, one (1) Mobile Phone (Brand/Model), one (1) External Hard Drive, one (1) Pen Drive and other ancillary storage media and documents shall be returned and released to the Defendant.
12. The Registry is directed to return and release the said devices submitted CS(COMM) 1005/2025 Page 2 of 3 This is a digitally signed order.
