These OAs having been taken up together and heard on 10th December, 2018,
the Tribunal delivered the following common order on 19th December, 2018:

By E.K.Bharat Bhushan, Administrative Member Since all these Original Applications are on the same issue, i.e., transfer of Staff Nurses working under the Employees' State Insurance Corporation to the establishments outside the State, with similar issues of law and facts involved, these are being disposed of through a common order:
2. The OAs, as per numbers given above, were all filed in December 2017- January, 2018 period. They are filed by Staff Nurses employed under the 57 OA 970/17 and connected cases respondent No.1 and posted at various hospitals in the State of Kerala. They are aggrieved by their transfer to hospitals outside the State. They challenge their transfer on the ground that they were recruited in the Kerala region and the transfer outside the region can be ordered by the respondents only if they are on promotion as per Annexure A1.
3. Counsel for the respondents, Sri Sandesh Raja had entered appearance in these cases when the matter was taken up in December 2017-February, 2018. At the first sitting itself, this Tribunal had directed the respondents to keep the operation of the transfer order in abeyance qua the respective applicants. The position remains unchanged till now. The learned counsel for the respondents has been repeatedly seeking time for filing reply statement. The OAs have been posted at frequent intervals, but we have been unable to adjudicate the cases for want of reply statement. When the OAs were finally posted today (10.12.2018), the learned counsel for the respondents again sought adjournment for filing reply statement.
The Central Administrative Tribunal (Procedure) Rules, 1987, Rule 12(1) reads as under:
"12. Filing of reply and other documents by the respondents:-
(1) Each respondent intending to contest the application, shall file in triplicate the reply to the application and the documents relied upon in paper book form with the Registry within one month of the service of notice of the application on him.

4. In these cases, it is seen that nearly a year has gone by and replies of the respondents have not been filed. The facts being so, we are left with no alternative but to allow the OAs. The reliefs sought in the OAs are to be granted in full to the respective applicants. Accordingly we grant the reliefs to the applicants, disposing of the OAs.
