Facts :-
Heard today dated 14.03.2012. Appellant not present. HPCL is represented by Shri Rajesh Kumar, Senior Executive Engineer(Retail Upgradation), Udaipur.
2. Vide RTI application dated 2.5.2011, the appellant had sought the following information in connection with the proposed allotment of retail dealership at village More of Tonk District in Rajasthan :-
(a) copy of the complaint lodged by one Shivraj against the appellant;
(b) decision taken by HPCL on the said complaint; and
(c) decisions taken by HPCL on other complaints in similar matters etc.
3. During the hearing, Shri Singh submits that the final orders regarding allotment of retail dealership are yet to be passed and the matter is still under investigation in terms of section 8(1)(h) of the RTI Act and the information cannot be disclosed.
4. In my opinion, disclosure of information requested for in paras (a) and (b) above is not likely to effect the decision making process. Nor is it going to cause any prejudice to the parties. Even the CPIO in letter dated 25.5.2011 has offered inspection to the appellant in this matter. In the premises, it is ordered that the information requested for in paras (a) & (b) above may be supplied to the appellant, free of cost. However, no information needs to be supplied regarding para (c) above.
4. This order may be complied with in 04 weeks time.
