Page No.# 2/2 This is an application under section 482 of the Cr.P.C praying for quashing of the FIR being Paltan Bazar PS Case No.384 IPC and charge sheet dated 04.10.2021 filed in connection with the Paltan Bazar PS Case No.412/2017.
Issue notice returnable on 09.10.2023. Mr. D Das learned Addl. PP accepts notice on behalf of the respondent No.1, so no notice is required to be issued upon the respondent No.1, however, extra copy of the petition be served upon the learned Addl. PP during the course of the day.
At this stage this court is not inclined to issue notice to the respondent No.2, however, the same shall be considered after perusal of the case diary.
No interim order staying the proceeding is being passed today. Though this court has not stayed the further proceeding of PRC Case No.2374/2021 pending in the court of JMFC, Kamrup (M), Guwahati, however, the same shall be subject to the outcome of the present revision petition.
List accordingly.
