        Petition filed under Article 226 of the Constitution of India, for
issuance of a Writ of Mandamus, to forbear the respondents 3 to 5 from in any
way appointing any candidate in the sanctioned post of Assistant Professor
(Mathematics) at the fifth respondent College bypassing the petitioner's
seniority and consequentially to direct the respondents to consider the
petitioner for appointment to the post of Assistant Professor (Mathematics)
by following the petitioner's seniority/rank list maintained by the Diocesan
Employment Bureau in terms of Chapter XXVI of Rule 60.5 of the C.S.I.
Kanyakumari Diocese, Constitution and Rules, 1960 within the period that may
be stipulated by this Court.

:ORDER  

The learned counsel for the petitioner seeks permission of this Court to withdraw the Writ Petition with liberty to the petitioner to approach the respondents and he has also made an endorsement to that effect.

2. In view of the endorsement so made, the Writ Petition is dismissed as withdrawn by giving liberty to the petitioner to approach the respondents. No costs. Consequently, the connected miscellaneous petition is also dismissed.
