Petitioner is alleged to have duped a number of persons with false promise to send them abroad while running an immigration consultancy under the name of Healthyway Immigration Consultants Pvt. Ltd.. He was involved in 11 cases. He has been granted the concession of bail in 9 cases as he has compromised the matter with the aggrieved persons by paying money to them which was received by him. In the present case, the petitioner has paid money to 21 complainants/ PWs.

CRM M-8817 of 2012 (O&M) [2] The bail petition has been opposed inter-alia on the ground that five persons have not been satisfied for payment of Rs.5.54 lacs.

I have heard counsel for the petitioner as well as counsel for the State and I am of the opinion that the petitioner can be granted the concession of bail as he has satisfied majority of the complainants. It has been undertaken by counsel for the petitioner that on release on bail the petitioner will be able to satisfy the remaining complainants by repaying the amount due to them.

In the interest of justice, the petition is allowed. The petitioner will be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the trial Court/ Duty Magistrate.
