Hon'ble Shri Justice P. Sam Koshy Order on Board 05/02/2020

1. Challenge in the present writ petition is to the order dated 31.12.2019 passed by Respondent No.2/Sub Divisional Officer (Revenue) whereby the Fair Price Shop alloted to the Petitioner has been suspended on the alleged ground of certain irregularities.

2. The impugned order passed by the Sub Divisional Officer (Revenue) is an appealable order and the appeal against the said order would lie before the Collector.

3. In view of the fact that there is a provision of appeal available, the present writ petition is being disposed of directing the Petitioner to approach the Appellate Authority. Subject to the Petitioner preferring an appeal, the Appellate Authority i.e. Respondent No.2/Collector is expected to decide the same at the earliest, preferably within a period of 60 days from the date of filing of appeal.

4. The writ petition accordingly stands disposed of.
