Learned Senior Counsel appearing for petitioner has filed IA No.22209/2024 for recall of order dated 28.08.2024. By said order stay granted in favour of petitioner has been vacated.
Learned Senior Counsel appearing for petitioner submitted that case was listed for hearing on 28.08.2024. On said date none appeared for petitioner, therefore, stay granted in favour of petitioner was vacated. It is further submitted that counsel who is in charge of the file was ill and subsequently he died on 11.09.2024 because of his ill health he could not appear before this Court. Said facts has been mentioned in application and affidavit in support of said facts is also placed on record. In view of same, he prays for recalling of order.
Government Advocate appearing for State Government formally opposes the application.
Heard counsel for the parties.
Considering the reasons which has been assigned by Senior Counsel for none appearance of the counsel on 28.08.2024. Said order is recalled.
