UPON hearing the counsel the Court made the following
O R D E R
1. Petitioner No. 1 is the developer of a project, namely, ‘Pedestal @70A’, Sector 70-A, Gurugram, and petitioner No. 2 is a Director of the petitioner No. 1-company. The Central Bureau of Investigation (CBI) has registered FIR No.RC2192026E0001 at Police Station Economic Offence Wing-I, New Delhi against the petitioners, in purported compliance of our order dated 23.09.2025 passed in SLP (Civil) No.7649/2023 as well as subsequent orders passed in that batch of Special Leave Petitions/Writ Petitions. To briefly recall, Signature Not Verified Digitally signed by NITIN TALREJA Date: 2026.04.23 this Court had directed the CBI to conduct a thorough probe into 16:55:10 IST Reason:
the alleged collusion and connivance between Real Estate 1 Developers-cum-Builders and the financial institutions in the context of subvention schemes.
2. The inclusion of the petitioners in the said FIR has been at the instance of respondent Nos. 2 and 3, who are homebuyers in the above-mentioned project of the petitioners. Learned Senior Counsel representing the petitioners has averred that 180 units have been developed and completed in the project and that barring respondent Nos. 2 and 3, no other home buyer has lodged any complaint against them.
3. We have heard learned senior counsel for the petitioners, as well as Mr. Rajiv Jain, learned Amicus Curiae, and Ms. Aishwarya Bhati, learned ASG representing the CBI.
4. Since the CBI is already investigating all the issues comprehensively, we dispose of this Writ Petition with liberty to the petitioners to produce the entire material before the CBI to enable it to investigate the allegations made by respondent Nos. 2 and 3 as also the claim projected by the petitioners.
5. As rightly pointed out by Ms. Aishwarya Bhati, the CBI is already filing status reports from time to time in the lead case. The claim asserted by the petitioners before us may, thus, also be verified in that process and included as part of the report of the CBI expected to be filed by the next date of hearing in the main case.
6. Pending application(s), if any, shall stand closed.
