choose to reply or make any payment.          The appellant

followed up with a second notice, issued through its counsel, making a demand over again, on the basis of the dishonour of the cheque dated 12.03.2003. Since the respondent failed to respond even to the second notice, a complaint was lodged. The defence that was sought to be set up prompted the trial Court to frame the following points for its consideration:

"(i) That, complaint Society has issued two demand notices on dishonour of cheque one as per Ex.D.7 (on 28.02.2003) and another on 12.03.2003 as per Ex.P.5. On that count, complaint could have been filed either on 0 1.05.2003 or on 28.04.2003 whereas the complaint has been filed on 09.04.2003 and therefore, complaint is prematured.
(ii) That, even a day before the date of cheque, accused had given notice that? there is no sufficient funds in her account arid instead of presenting a cheque, Society can recover the dues by selling the mortgaged property. In spite of that, to harass the accused, Society has presented the cheque on receipt of said notice.
