                    The writ petitioner is keen on carrying
                on business as an M.R. dealer. He resides
                in Ratua sub-division in the district of
                Malda. He says that in this sub-division,
                comprising of 10 villages there are 9500
                ration     card   holders   and   one   dealer.
                According to the government policy there
                should be one dealer for not more than
                5000 persons.


                    Therefore, for a population with 9500
                ration cards there should be at least two
                dealers.


                    If these facts are considered by the
                government, according to the petitioner,
                he has a chance to be considered to be
                appointed as an M.R. dealer.


                    In these circumstances, I direct the
                respondent no. 3 to consider the above

facts and come to a reasoned decision, regarding creation of a second dealership in the above area after giving hearing to the writ petitioner, within three months of communication of this order.

This writ application is accordingly disposed of.

Urgent certified photocopy of this order, if applied for, shall be given to the parties subject to compliance with all requisite formalities.
