ORDER
% 13.09.2022 Learned counsel for the parties have fairly stated before this Court that the present LPA be disposed of in terms of the order dated 05.08.2022 passed in W.P.(C) No. 7391/2020, Gold Plus Glass Industry Limited v. Union of India & Ors. The aforesaid order reads as under:
"The petitioner had approached this Court seeking quashing of the orders passed by the Export Promotion Capital Goods Committee [EPCG] on 29 March 2019. They had also sought the grant of redemption certificates in respect of the EPCG licenses which were held and against which goods had been supplied to the SEZ without filing of Bills of Exports. Ms. Lakshmi Kumaran, learned counsel appearing for the petitioner, has drawn the attention of the Court to the Circular dated 27 July 2022 in terms of which a decision appears to have been principally taken to relax the condition of Signature Not Verified Digitaaly Signed By:BHUPINDER SINGH ROHELLA Signing Date:16.09.2022 17:11:00 requirement of submission of Bills of Exports in case of exports made to SEZ units under EPCG authorization for all supplies made prior to 01 April 2015.
In view of the aforesaid circular, Ms. Arora, learned CGSC appearing for the respondents submitted that the claim of the petitioner shall be reexamined and an appropriate decision taken thereon with expedition. The statement so made is recorded and accepted.
In view of the aforesaid, nothing further would survive on the writ petition. It shall stand disposed of along with pending application. Liberty stands accorded to the petitioner to approach afresh if circumstances so warrant."
Learned counsel for Union of India was fair enough in stating before this Court that recently a Policy Circular No. 39/2015-20dated 07.06.2022 was issued and the claim of the Appellant can certainly be looked into keeping in view the aforesaid circular.
In the light of the aforesaid, the LPA stands disposed of. The case of the Appellant be re-examined in the light of the aforesaid circular.
