O R D E R
While disposing of Civil Appeal No. 341 of 2017, the following directions were issued by this Court, after recording a settlement between the parties, which is as follows:
“i) The marriage between the appellant and respondent will stand dissolved.
ii) The appellant will bear the expenses for the marriage of his two daughters and also deposit Rs.5 lacs in the names of each of his daughters.
iii) The appellant will continue to pay Rs.13,000/- per month to the respondent after the marriage of his daughters.
(iv) The observations made by the Family Court, Warangal against the respondent are expunged.” This contempt petition has been filed due to non-compliance of the above directions issued by this Court recording the terms of the settlement. The Signature Not Verified complaint of the petitioner is that the arrears of Digitally signed by BALA PARVATHI Date: 2022.04.27 17:34:40 IST maintenance were not paid @ Rs. 13,000/- p.m. as directed Reason: by this Court and only Rs.10,000/- was deducted from the respondent’s salary. The respondent is directed to pay 2 the arrears of maintenance @ Rs. 13,000/- p.m with a period of three months from today. Going forward, deductions shall be made from his salary @ Rs.13,000/-
p.m. by the Senior Divisional Officer, South Central Railway.
We are informed that the respondent has already deposited Rs.5,00,000/- in the names of each of his daughters. However, the petitioner submits that she conducted the marriage of the elder daughter, for which she had to raise a loan of Rs.3,00,000/- owing to the expenses of the marriage. The direction given to the respondent to bear the expenses of the marriage of the two daughters has been willfully disobeyed by him. The respondent is directed to pay an amount of Rs.3,00,000/- to the petitioner, for the expenses of the marriage of the elder daughter, within a period of eight weeks from today. He is also directed to meet the expenses of the marriage of the second daughter, as and when it takes place.
The contempt petition is, accordingly, disposed of. Pending application(s), if any, shall stand disposed of.
