FACTS

Vide RTI dt 10.5.13, appellant had sought copy of complete file noting and correspondence including copy of reply sent to Ministry, relating to disposal of MHRD letter dt 31.7.12 issued by Shri BK Bhadri, MHRD to CMD EdCIL.

2. PIO vide letter dt 10.6.13, informed the appellant that no such information is available with reference to letter dt 31.7.12.

3. An appeal was filed on 10.6.13 questioning the response of the PIO and providing a copy of letter dt 31.7.12.

4. AA vide order dt 4.7.13, upheld the decision of the PIO and observed that the letter dt 31.7.12 attached by the appellant is unsigned.

Subsequently, appellant vide letter dt 9.7.13 provided a signed copy of the letter wherein the date was changed to 16.8.12 and stating that the same was received by EdCIL's messenger Shri Mange Ram.

5. Submissions made by the appellant and public authority were heard.

DECISION

6. The Commission finds that in his RTI the appellant has sought information with reference to MHRD letter dt 31.7.12, to which the PIO had responded that no such information was available. Subsequently, in his appeal, appellant clarified that he was referring to letter dt 16.8.12 which was received by EdCIL on the same date. We direct PIO to provide a response to the RTI within ten days from date of receipt of the order, in respect of letter dt 16.8.12.

The appeal is disposed of.
