                                  ORDER

1. In compliance with our previous order dated 05.10.2023, the Joint Committee has submitted its report dated 29.05.2024, which is annexed at page nos.5 to 26 of the paper book, relevant part of which is extracted herein below:-

"Background:-
Malad Lake- "Shree Ram Sarovar Lake" is located at Malad, Tal- Daund, Dist-Pune. Malad Lake is a naturally formed lake and about 4 km from Kurkumbh MIDC area. Its stored water is used for the surrounding agriculture during the non-rainy season. The water from the said lake is not used for drinking. The Malad Lake is fed by rainwater as well as small streams and drains flowing through the surrounding areas. The said lake gets completely dry in summer.

2. Our attention is drawn by the learned counsel for respondent No.2- MIDC and respondent No.4-MPCB to page no.19 of the paper book, which is the Test Report dated 02.01.2024 of water sample collected from Malad Talav, Daund on 03.10.2023, in which no chemical poison was found. Page 7 of 8

The issue involved in the present Original Application is relating to pollution in Malad Talav, wherein as per the allegation, dumping of industrial waste is being done and the untreated water is being released by the industries, which are located in Kurkumbh MIDC area. In this regard, the Joint Committee Report has submitted its recommendations, which are cited above at serial nos.1 to 17.

4. As regards the Recommendation at point no.1 providing for a scientific study of Water Audit and Power Audit of all Industries in the area in question is to be carried out to find out the defaulters' unit, this suggestion is acceptable to us and we direct that the respondent No.3- MPCB may take appropriate steps in this regard and also take appropriate steps in case any defaulter is found to be there.

5. With respect to the Recommendations at serial nos.4, 6, 10 & 12, the respondent No.3- MPCB has already issued directions to the respondent No.2- MIDC through their letter dated 06.10.2023, which is annexed at page nos.20-21 of the paper book.

6. Regarding rest of the Recommendations, which are made by the Joint Committee and have been cited by us above, we direct that the same shall be implemented by the respective agencies i.e. respondent No.2- MIDC and respondent No.3- MPCB.

7. With the above direction, we dispose of this application accordingly.
