Counsel for the petitioner pleads no instructions as he states that a registered letter written to the petitioner at the address available with him has been received back undelivered.
Counsel for the respondent, on the other hand, submits that the petitioner had to comply with the order dated 29.05.2013, according to which, dispossession of the petitioner was stayed, provided he cleared the entire arrears of rent by 15.07.2013 and further continue to pay the admitted rent in advance by 10th of each calendar month, which the petitioner has failed to comply with. handed over by the petitioner-tenant to the respondent-landlord in the execution proceedings. He, on this basis, submits that the petition has been rendered infructuous qua the eviction of the petitioner-tenant. He, however, prays for liberty to claim the mesne profits from the petitioner in accordance with law.
In view of the statement made by counsel for the respondent, the present revision petition is disposed of as infructuous qua the ejectment of the petitioner from the demised premises. Liberty is granted to the respondent to avail of his remedy in accordance with law for grant of mesne profits, if any.
