R.A.No.307 of 1993 in 11 CWP No.14371 of 1990 This order shall dispose of aforementioned 87 review applications arising out of order passed by the Division Bench of this Court on 10.10.1990, whereby it was ordered that till such time, the persons higher in merit in the list prepared by the Subordinate Selection Board Haryana are appointed, such list shall not lapse.
The said direction came to be issued in view of the fact that as many as 5373 candidates were recommended for appointment against 662 posts of Clerks in different Departments of the State Government vide merit list dated 15.10.1989. However, the appointments were made to the candidates lower in merit by ignoring the persons higher in merit. The Division Bench of this Court, in these circumstances, ordered that the merit list prepared on 15.10.1989 shall not lapse and the persons higher in merit shall be appointed first. The review was sought on the ground that the large numbers of candidates are higher in merit and if such directions are to be complied with, the right of the numerous other candidates will stand jeopardised for large number of years.
After the review applications were filed, another Division Bench in CWP No.174 of 1992 doubted the correctness of the order passed by the Division Bench on 10.10.1990. The matter was referred to the Larger Bench. The Full Bench in its judgment reported as Bijender Singh etc. Vs. The State of Haryana etc. 1994 (3) PLR 1, ordered that all vacancies arising from 15.10.1990 shall be re-advertised, as the list prepared by the Board on 15.10.1989 was valid for a period of one year.
In appeal against the said order, the Hon'ble Supreme Court in Roshni Devi and others Vs. State of Haryana and others (1998) 8 SCC 59, has held that the appointments already made from out of the list prepared on 15.10.1989 will not be annulled. The Court noticed that another R.A.No.307 of 1993 in 12 CWP No.14371 of 1990 advertisement has been issued in the year 1995. Therefore, the appointments from the previous list shall be made in respect of the vacancies arising prior to the advertisement issued in the year 1995.
Since the direction of this Court to appoint candidates higher in merit stands modified by the Hon'ble Supreme Court in Roshni Devi's case (supra), the present review applications are disposed of in the same terms of Roshni Devi's case (supra).
