JUDGMENT Ashutosh Mohunta, J.
1. The petitioner has prayed for setting aside the order Annexure P-3 dated 12.7.2005 passed by the Financial Commissioner Appeals-II by which the candidature of the petitioner for the post of Lambardar was rejected and respondent No. 2 was appointed as the Lambardar. A perusal of the impugned order shows that two criminal cases were registered against the petitioner. Although learned Counsel for the petitioner has argued that the petitioner has been acquitted in both cases, however, keeping in view the fact that the petitioner does not have a clean record, we are not inclined to interfere in the writ jurisdiction under Article 226 of the Constitution of India.
