Bench: V.Ramasubramanian, N.Kirubakaran
BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED: 28.01.2016 CORAM THE HONOURABLE MR.JUSTICE V.RAMASUBRAMANIAN AND THE HONOURABLE MR. JUSTICE N.KIRUBAKARAN W.P(MD)No.1887 of 2016 A.Mohammed Feroz Khan ... Petitioner Vs. 1.The Home Secretary, Government of Tamil Nadu, Fort St. George, Chennai. 2.The Director General of Police (D.G.P.,) Tamil Nadu. 3.The Superintendent of Police, Trichy District. 4.The District Collector, Trichy District. ... Respondents Prayer: Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus to direct the respondents 1 to 4 to refuse permission to conduct the said congregation/gathering. !For Petitioner ... Mr.A.S.K.Sha ^For Respondents ... Mr.N.Manoharan, Special Govt. Pleader :ORDER
(Order of the Court was made by V.RAMASUBRAMANIAN,J.) The petitioner has come up with the above writ petition purportedly in public interest seeking a Mandamus to direct the respondents 1 to 4 to refuse permission to a congregation of a Muslim organisation to conduct a conference under the name "SHIRK OZHIPPU MAANAADU".
2. Heard Mr.A.S.K.Sha, learned Counsel for the petitioner.
3. An organisation by name, Tamil Nadu Towheed Jamath appears to have called for a conference under the title "SHIRK OZHIPPU MAANAADU". The word 'Shirk' is an Arabic word that means, there is only one God. It appears that the conference is sought to be organised for the purpose of removing what the organisation, namely, Tamil Nadu Towheed Jamath believes as unislamic or superstitious.
4. We do not know how the petitioner can oppose the convening of such a conference in a country where the freedom of expression is guaranteed under Article 19(1)(a) of the Constitution of India. As a matter of fact, the petitioner has not even impleaded the Tamil Nadu Towheed Jamath, which is organising the conference, as a party to the writ petition. We do not know how the organisation of such a conference would even fall under the categories which could be prohibited by law in terms of Article 19(2) of the Constitution of India. Therefore this writ petition is absolutely devoid of merits. Hence, it is dismissed. No costs.
To
1.The Home Secretary, Government of Tamil Nadu, Fort St. George, Chennai.
2.The Director General of Police (D.G.P.,) Tamil Nadu.
3.The Superintendent of Police, Trichy District.
4.The District Collector,
Trichy District. .
