Primary School under Mathabhanga-I Circle, Coochbehar.
The present writ petition has been filed by the petitioner seeking an inter-district transfer. The petitioner alleges that he could not submit an online application for transfer through the Utsashree Portal, which is presently suspended by an order dated September 29, 2022, issued by the State.
The petitioner, however, submits that he had already made an application before the Secretary, West 2 Bengal Board of Primary Education, which was received on November 4, 2025, but no steps have been taken by the Secretary.
The issue regarding the suspension of the Utsashree Portal and the right of a teacher to apply for transfer was addressed by the Division Bench of this Court in MAT 339 of 2024, dated March 12, 2024 (Apurba Biswas vs. The State of West Bengal & Ors.). In that judgment, the Division Bench directed the concerned authorities to consider the transfer prayer of petitioner notwithstanding the suspension of the Utsashree Portal.
In view of the above, there is no justification to keep this writ petition pending. The Secretary, West Bengal Board of Primary Education, is directed to consider the representation of the petitioner received on November 4, 2025, in accordance with the West Bengal Primary Education (Transfer of Teachers including Head Teacher) Rules, 2002, preferably within a period of six weeks from the date of communication of this order.
Accordingly, WPA 2385 of 2025 is disposed of. Urgent Photostat certified copy of this order, if applied for, be given to the parties upon compliance with all requisite formalities.
