The petitioner has called into question the 4111 respondent's communication, dated 04.05.2011 (Annexure-A) which states that the petitioners for admission to M.D.S. Course in application 012 Is Orthodontics for the academic year 2011-2 cancelled.

2. The facts of the case in brief are that petitioner has done his B.D.S. from Mahar ashtra secured University of Health Sciences. Nasik. He has 58%. He sought admission to M.D.S. Orthodontics at the 4th respondent College. The 4111 respondent College the provisional admission letter, dated issued extracted 07.02.2011 (Annexure-D). Its contents are hereinbelow:

4(1) A candidate who fulfill the following criteria shall be eligthle to appearfor the Entrance Test namely:

12. As neither the petitioner nor his parents are of Karnataka origin, he is not even eligible to appear for the entrance examination conducted by the PGET or Corned-K in Karnataka. He also read out Rule 7(3) for advancing the contention that If any seats are left over even on the completion of re-counselling. the management van ifil tip the remaining seats. He submits that Rule 17 ftirther amplifies the position. It reads as follows:

pure NW students. As admittedly. the petitioner Is not an NW student, he can not be exempted from appearing for the entrance examination and the provisional admission can not be confirmed.
21. He has also relied on the Apex Court Judgment in the case of Secretary U.P.S.C. & Anr. va S.Krishna Clzaitanya reported in 2011 AIR SCW 4682. The paragraphs read from the said decision are extracted hereinbelow:

24. To answer these questions. it Is necessary to refer to the Dental Council of India Revised MDS Course Regulations, 2007 (hereInafter called as 'the 2007 Regulations' for short). The relevant provisions are extracted hereffibelow "Eligibility:
A Candidate for admission to the MDS Course (Master of Dental Swpery) must have a recognised degree of BDS (Bachelor of Dental Swpery) awarded by an Indian University In respect of recognised Dental College under Secion 10(2) of the Dentists Act. 1948 or an equivalent quaI1catlon recognized by the Dental Council of India and should have obtained permanent registration with the State Denial Council. expressly state that a student to be admitted in the management quota ought to have secured 50% in the entrance test conducted by the Government.
26. In the instant case, the fourth respondent College has not furnished the particulars as to how many students applied for the admission to MDS Course in the speciality in question and whether the fourth respondent College itself has held the entrance examination or whether the selected candidate Shilpi is more meritorious than the candidates, who were not selected for admission.
27. As far as the three demand drafts produced by the petitioner in Annexure E series are concerned, it is the version of the fourth respondent College that they are paid by one Dr.Ishan Gupta. who is selected? admitted to another P.G.Course by the fourth respondent College in the same academic year (2011- 2012). On my directing the fourth respondent College to produce the two applications received by the College ASH.

At this rate. i.e., in the absence of the prescript ion of the date of the commencement of admission process, the Institutions may start receiving the applications for admission few years before the commencement of a particular academic year. In the Instant case. the petitioner was called for Interview for admission to MDS Course on 10.2.2011, as Is evident from the tburth respondents communication. dated 3.2.2011 (Annexure-C). The question of a candidate being called for Interview would arise only when he clears the written test. In the instant case, if it Is the fourth respondent College's case that an applicant for admission to MDS Course must have secured 50% In the entrance test. it is not understandable as to how he would have been called for the Interview even before holding of the entrance test. It is high time, the RGUHS, the regulator and enhancer of the academic standards prescribe the date of the commencement of admission process.

The perusal of the above extracted eligibility certificate reveals that the RGUHS has certified that the petitioner has the eligibility for admission to the first year MDS Course of RGUHS, as he has passed his BDS examination. The RGUHS has not imposed any condition or rider on the eligibility certificate that the petitioner can seek admission to the MDS Course, If he only secures 50% of the marks In the entrance test. On the other hand. a general condition Is Imposed which states that It Is subject to the fulfillment of other conditions, as prescribed under the University's Rules and the Instructions given therein below. None of the University's Rules or the instructions given by it prescribIng 50 marks in the entrance test are brought to my notice.

36. On the other hand. the petitioner's side has produced the confirmation letters Issued by ViJaya Bank. Andheri that the demand drafts are encashed. I notice with concern that on the petitioner's application, the fourth respondent's office has written 'collect' tuition fee'. On the application ified by Dr.Ishan Gupta.
no such endorsement or clearance is indicated. In the absence of such Instruction, the amounts would not have been collected from Dr.Ishan Gupta towards the admission.
37. All these facts and circumstances go to show that the petitioner was indeed given admission by the fourth respondent College to the MDS Course for the years 2011- 12. Now the question that arises is whether the petitioner had the eligibility to seek the admission to MDS Course in the absence of his securing 5GYo In the entrance test conducted by the Government. That the .7

applicant for the admission to the Course in question must have a BDS recognized degree as per the Dental Council of Indl&s Regulations and that the petitioner has passed his BDS securing 58% are not in dispute.
The further question is whether obtaining 50% in the entrance test Is an eligibifity criteria for admission to MDS Course. Neither the application nor the prospectus nor any University's statute are shown to me as prescribing such a clarification.
38. The stand of the respondent Nos. 5 and 6, as taken In their counter is that there is no specific condition In the Consensual Agreement for the year 2011-2012 entered Into between Karnataka Private Medical and Dental College Association and the State Government that the member Institutions should admit/allot seat only to candidates who are qualIfied in a written test conducted by the 5th respondent.
