1) The petitioner has challenged the order dated 07.02.2019 passed by the learned Civil Judge, Class-II, Durg (C.G.) in Civil Suit No.102-A/2017, whereby, an application moved by the defendants under Order 7 Rule 11 of the CPC was allowed.
2) Learned counsel for respondent No.4 would submit that according to the provisions of Order 2 Rule 2 of the CPC, rejection of the plaint under Order 7 Rule 11 of the CPC would be a deemed decree and first appeal would lie against the said order.
3) Taking into consideration the above stated fact, present petition is dismissed. However, the petitioner would be at liberty to take recourse to law.
