Justice Permod Kohli, Chairman The applicant has been ordered to be transferred vide impugned Office Order No. 364 dated 08.08.2017 from Delhi office to the Regional office, Patna with immediate 2 OA 2784/2017 effect. The grievance of the applicant is that the order is punitive in nature and no circumstance exists for his transfer as indicated in the Judgment of Hon'ble Supreme Court in case of Ajay Kumar Chaudhary Vs. Union of India in Civil Appeal No. 1912/2015 dated 16.02.2015. The applicant has also made a representation dated 11.08.2017. Mr. Ajesh Luthra, learned counsel for the applicant submits that the applicant would be satisfied if a direction is issued to the respondents to consider his representation.
2. In this view of the matter, this petition is disposed of with a direction that respondents shall consider the representation of the applicant dated 11.08.2017 Annexure A/6 within a period of one month from the date of receipt of a copy of this order by passing a reasoned and speaking order. Till then, the order impugned will not be implemented, if not already implemented. No costs.
