2/ 28.08.2009Heard Mr. Uday Kumar, learned Counsel for the petitioner and learned APP appearing on behalf of the State.
The petitioner is an accused of the case which has been registered for the offences under Sections 363 /366(A) /120(B)/34 of the Indian Penal Code.
The informant has alleged that his daughter Pratima Kumari aged 13 years was forcibly kidnapped by this petitioner and others.
Submission is that the alleged victim has recorded her statement under Section 164 of the Code of Criminal Procedure in which she has stated she has left the school in the year 2000 and has developed intimacy with the petitioner. It was not liked by her 2 guardians so she escaped and married with the petitioner and ultimately she carried pregnancy of three months. Annexure-3 is the medical report and according to the report it appears that the alleged victim is of 17 to 19 years.
Considering the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate/concerned court, Sitamarhi in connection with Kanhauli P.S. Case No.- 34 of 2008.
